This privacy statement (“Policy”) describes how Quantum Software Solution and any of its affiliates (“we,” “us,” or “our”) will collect, use, disclose, and transfer your information for the purposes listed below: operating the Promise Mobile App (“App”), the “Promise App” application (the “App”) available on Google Play Store and other comparable platforms, and providing other services such as maintaining the details of exchange of goods and services .The Terms of Use for the Promise App Services include this Policy in full. The definitions given to capitalized terms used here but not defined in the Terms of Use apply to them as well.

Users (as indicated below).

The App/Site (collectively, “Services”) I offers an online digital ledger book / record book where Users can record their ledger entries with their respective customers;

Please be aware that “Services” includes any other services we could offer in the future. This Policy may change as we update, enhance, and broaden the Promise App Service, so please check back frequently. You consent to the collection, storage, and use of the personal information you supply (including any modifications thereto as given by you) for any of the services we provide by using the Site, App, or otherwise using the Promise App Services.

We are dedicated to protecting your privacy in all ways in a way that is reasonable given your usage of the Promise App Services (“Users” or “you”). The information we have about a User is made up of two types of data:

(a) Information provided by Users and

(b) Information that is automatically recorded when a mobile device with Promise App Services turned on is in use. You accept this Policy by using the Promise App Services. Please refrain from using or accessing the Promise App Services if you disagree with any term in this Policy.

INFORMATION SUPPLIED BY USERS

Users must register in order to use some Services on the Promise App, and during that process they may be asked for their name, email address, phone number, information about their business entity, account number, KYC information, and other personal information as needed. We are able to deliver the Services, enhance the Promise App Services, and give you the most streamlined experience thanks to the Information provided by the Users. In rare circumstances, we may also need your contact address in order to provide a particular service or utility. In order to communicate exchange (Give & Take) updates with his clients, Users are further asked to provide the App access to their contact list (as kept on the mobile device on which the App is downloaded) (who might be or might not be Users). In order to enhance and improve the User experience of the App, the User’s contact list is uploaded to https://api.Promiseapp.com. We may occasionally gather information (other than what is described above) from Users through the App / Site in an effort to improve our Services. You may be assured that we only disclose this information in line with the provisions of this Policy and at no other time.

In accordance with this Policy, secure transfer, and the user’s needs for conspicuous disclosure, we may access a user’s list of installed applications and classify this information as sensitive or personal data.

All information is service-dependent, and we reserve the right to use it for a variety of purposes, including service provision, service upkeep, service security, service improvement, and service creation.

We may also use your email address and phone number without additional agreement for marketing, non-marketing or administrative purposes (such as alerting you of important changes, for customer support purposes, giving information about upgrades to Promise App Services, billing, etc). (Such as notifying you of major changes, for customer service purposes, providing information about updates to Promise App Services, billing, etc.).

If the information you submit is readily accessible in the public domain or is not regarded as personal information under the relevant legislation, it will not be considered information you gave. Additionally, any testimonials, remarks, messages, or blogs that Users post, upload, express, or communicate on the public areas of the Site or in an application store (such as the Play Store), become published material and are not regarded as personal information that is covered by this Policy.

We might not be able to provide you some services on the Promise App/Site if you decide not to submit Information there. We’ll do reasonable attempts to let you know about it when it’s time. In any event, we won’t be held accountable or liable if we can’t provide you with certain services because we didn’t have the information we needed from you.

When you register for the Promise App Services, we could occasionally contact you about updating your information (at our discretion).

INFORMATION AUTOMATICALLY TRACKED WHILE USING THE APP OR SITE

Customer Information: We keep track of your customers’ contact information. We also retain a record of all communications with clients regarding exchanges (Give & Take)

Demographic and Related Information: In order to provide you messages and promotions that are more specifically tailored to your interests, we may consult various sources of demographic and related information. We monitor user behavior on the website using a variety of tools, including Google Analytics.

Log File Information: When you visit our site or use the app, our servers automatically record a small amount of data, including your IP address, about the internet connection of your device. We may also gather log information from your device, including but not limited to your location, IP address, device’s name, device’s serial number or unique identification number (e.g., UDID on your IOS device, Android ID or ADID on your Android device), your device operating system, and browser. We automatically receive and log Information from the App and/or your browser, including but not limited to IP address, your device or computer’s name, and your operating system.

LINK TO THIRD PARTY SITES/AD-SERVERS

Links to other websites, including advertisements, blogs, content sponsors, vendor services, social networks, etc., may be found on the Site. These websites’ individual privacy policies, which are outside of our control, govern these websites. We make no representations or warranties regarding how your information is stored or used on third-party servers once you leave our servers (you can determine where you are by looking at the URL in the location bar of your browser). Instead, the privacy policies of the owners of the websites you visit will govern the use of any information you provide after you leave their servers. That policy might not match ours. If any of these websites’ privacy policies aren’t accessible via a link from the homepage, you should get in touch with the website in question.

INFORMATION SHARING

The User hereby consents to the sharing of the Information (including personal information) acquired with our affiliates, group businesses, and any third party service providers, including marketing partners, as necessary for our internal business, administrative, and general corporate activities. We shall make reasonable efforts to ensure that these third-party service providers are bound by relevant confidentiality and non-disclosure duties, as well as by applicable data protection legislation, and that they are required to secure your personal information. Unless you specifically opt out, these organizations with which we share the Information may market to you as a result of such sharing.

The User expressly agrees that we may access their SMS, contacts in their directory, location, and device information, and that we may ask for their PAN and Know-Your-Customer (KYC) information to determine their eligibility for particular products and services, in order to improve their experience and give them access to the services we, our affiliates, or other third-party service providers offer (including lenders).

Additionally, the User agrees to share Information (including sensitive personal information) when requested or required to do so by law, a court, governmental agency, or authority, for the purpose of establishing the user’s identity, or for the prevention, detection, and investigation of incidents, including cyber incidents, as well as for the prosecution and punishment of criminal offences. These disclosures are provided in the good faith belief that doing so is reasonably required to uphold the Terms of Use or to adhere to the relevant legal and regulatory requirements. There is no personal information on a specific User, such as name, phone number, email address, spending information, payment information, etc. unless expressly authorized by the specific User in question, would be shared with any other Users and/or third parties. We may also provide aggregated statistics on data such as general app usage by date, time, balances, etc. within our App/Site or to our partners. These statistics may also pertain to User data recorded by us solely.

Users agree and consent to the disclosure, transfer, storage, and processing of their personal information (including sensitive personal information) by us in India and/or other countries to its affiliates, group companies, and third parties. This consent is given by using the Promise App Services and providing information to us. While our main goal is to safeguard Users’ disclosure of personal information, Users should be aware that the countries where their information may be held may not have the same data protection legislation as the countries in which they are situated.

ACCESSING AND UPDATING PERSONAL INFORMATION

We make good faith efforts to give users access to their information when they use the Site (or any of its sub sites) or App, and we’ll further make sure that any personal information, sensitive personal data, or other information found to be inaccurate or deficient shall be corrected or amended as practically possible, subject to any requirement that such personal information, sensitive personal data, or information be retained by law or for other legitimate business purposes. We may refuse to process requests that are excessively repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, would be highly impractical (for example, requests concerning Information stored on backup tapes), or for which access is not otherwise required. We ask specific Users to identify themselves and the Information they wish to access, correct, or remove before processing such requests. Anywhere we offer Information access and rectification; we do it without charge, unless doing so would involve an unreasonable amount of work. After you delete your Information, it could take some time for the remaining copies to be removed from our active servers due to the manner we maintain some services.

INFORMATION STORAGE AND BACKUP

We periodically take a backup of your Promise App data and store it in our cloud database. This is done to give users the ability to recover their data in the event that their phone becomes lost, the data on it becomes useless, or they switch to a different phone device. We also use this backup to provide the users with helpful insights and information about their spending, including weekly spending in a month, insights into spending behavior, etc. We also use it to provide aggregated and anonymized statistics on user spending by category, date, time, and other factors.

Until such time as we may offer the Promise App Services to the Users, we will maintain User’s Information in our records. When a User’s use of Promise App Services is no longer necessary, we delete all the information we have about that User from our files.

INFORMATION SECURITY

We take the necessary security precautions to guard against unauthorized access to or alteration, disclosure, or destruction of data, including manipulation that is unintentional or purposeful, as well as loss from access by unauthorized parties. To prevent unauthorized access to the systems where we hold personal data, these include internal evaluations of our data collecting, storage, and processing procedures and security measures, such as proper physical protection and encryption. The controlled database is where all the data collected by the Promise App is safely kept. Password protection and tight restrictions apply to access to the servers.

We continually analyze and upgrade our security procedures to take into account new technological advancements. We take all reasonable precautions to keep your personal information private no matter where it is sent or stored, but please remember that no data transmission over the internet or any other public network can be guaranteed to be 100% (one hundred percent) secure.

To secure the protection and preservation of the User’s privacy and personal Information, we work to ensure compliance with the requirements of the relevant data protection legislation. We have physical, technical, and procedural precautions in place to secure user personal information, and they all adhere to local legal requirements. By agreeing to the provisions of this Policy, you acknowledge that the policies and procedures we use to secure your personal information are reasonable and adequate.

Insofar as consistent with the legitimate needs of law enforcement, we will notify you of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored Personal Information via email or any other practical method as soon as is reasonably practical and without unreasonable delay, and we will take all steps necessary to ascertain the extent of the breach and restore the reasonable integrity of the data system.

PURPOSE OF DATA PROCESSING

Only when we have a legitimate reason to do so will we legally gather and use your personal information. In order to offer the customized Promise App and all of its features, we must first collect your information, including Personal Information. Please be aware that we might not be able to fulfill our obligations under the contract with you if you decide not to give us permission to gather your information, including Personal Information. When we say that we “perform the contract,” we mean the Terms of Use that apply to your use of the Promise App Service. As a result, you might not be able to use all of the Promise App Service’s features or we might not be able to provide you the Promise App Service at all.

We utilize your data, for instance, in situations where we require it to fulfill our contractual obligations to you (such as when providing you with access to the Platform or our services), in order to:

  • Sign up for our Platform.
  • Give you customer or technical help, such as by responding to questions about, but not restricted to, payment processing or by identifying any issues with our servers, etc
  • Send you transactional emails or SMS, or to give you access to information, direct marketing, online and offline advertising, and other materials regarding products, services, and other offers from time to time in connection with the Promise App Service or its parent, subsidiary, and affiliated companies (“Platform Entities”) and its joint ventures.
  • Identify your location to deliver localized content to you, such as advertisements and personalized recommendations, to let you watch or use previous content at a later time, to identify your Internet service provider to solve a technical problem, and to assist us in answering questions and requests as quickly and effectively as possible.
  • We do this by associating and storing this information with a specific platform generated identifier that is generated for each user in order to provide you with a personalized service and experience. Examples of this include exchanges made with Promise App and your activity on our Platform across all of your devices (guest as well as registered user). The information and data pertaining to a guest user’s prior actions are added to and connected with the registered account when the user later registers and opens an account
  • If the processing of your Personal Information falls under the EU General Data Protection Regulation in other circumstances, we use it when it serves our legitimate interests and is not in conflict with your Fundamental Rights and Freedoms (for instance, when we conduct direct marketing campaigns in accordance with your preferences), such as when we: Display or target advertisements on the Platform based on your registration or profile information, location, and/or other factors. On the Platform, we also show contextual advertisements, but they are not targeted at any particular user and don’t use any information that identifies you personally or locates you precisely (contextual advertising is advertising which we target based on the content being viewed, for example if you are watching a particular sporting event we may serve adverts of companies or products related to that particular sport or the age-group most likely to be watching).
  • To better our service (including user interface experiences and security features), research, analyze, and understand our audience and the content and advertising they may view, watch, or otherwise engage with; determine your eligibility for certain offers, products, or services; and market those products or services to you; perform analytics; and conduct customer research, including general market research or surveying our customers’ needs and opinions In an effort to give you the Services and a better experience on the Platform, we may use information we acquire about you collectively (e.g., by aggregating data) or individually (where permitted by law) in conjunction with data from other tracking technologies. Because this may be the statistic by which our advertisers pay us, one of the ways we utilize this information is to track the number of times an advertisement or other material is viewed. On an aggregate level, this data is gathered and examined.
  • Give you the opportunity to take part in interactive features like game play events on the platform, giving you relevant gameplay experience, deciding and announcing victors, and giving you rewards.
  • Determine which media sources should be compensated for delivering a desired activity, such as people who install our programme or subscribe (a process known as “attribution”), in order to analyze and evaluate the effectiveness of our advertising and ensure that we don’t overspend.

We will use your Personal Information with your explicit consent as follows:

  • You may see more regional content recommendations or advertisements for local businesses when you share your precise location based on GPS data. We will combine this information with other information you provide to us on the Promise App Service to provide personalized content and advertisements with better accuracy based on your geographic location.
  • When you agree to let us combine information about the apps you use most frequently on your Smartphone with other data you provide us through the Promise App Service, we can serve adverts that are more relevant to your interests.

Or in any other circumstance where the law requires us to get your consent or if we have indicated in this Privacy Notice that we may do so. When required by law or in order to safeguard your vital interests or the interests of another person, we may use your personal information.

  • Enforce our rules (such as deciding who is eligible for a free trial) and prevent, detect, and look into potentially unlawful or banned behaviors, including fraud.
  • If you are exercising legal rights, proving your identification.
  • Notify you of any modifications to the terms and conditions or this privacy notice.
  • Fulfill our commitments and uphold our rights under any agreements we may have made with you or our distributor.

You acknowledge that when you access or use the Services or send any data, inquiry, request, or message to us via our Support email, you are doing so electronically and that we may respond by email.

LINK TO THIRD-PARTY SDK

The App includes a connection to a third-party registered SDK that gathers information on our behalf and stores it on a secure server so that we may do a risk analysis. We make sure that our third-party service provider implements stringent security procedures to guard your personal information against loss, unauthorized access, or alteration. Separation of work environments and responsibilities are practiced by our third-party service provider, who also has tight role-based access control on a documented, permitted, need-to-use basis. Application-level encryption is used to safeguard and secure the data that is being stored. To restrict access to data, key management services are enforced. In addition, our authorized third-party service provider offers hosting security; they employ top anti-virus, anti-malware, intrusion-prevention systems, and intrusion detection systems.

REVOCATION OF CONSENT

A User has the right to cancel his or her permission at any moment with future effects to the processing of his or her personal information. Please be aware that revoking consent has no effect on our right to continue collecting, using, and disclosing personal information where doing so is allowed or required by relevant law.

RESPONSIBLE ORGANIZATION FOR THE DATA COLLECTION

Due to the fact that QUANTUM SOFTWARE SOLUTION now controls and provides all Promise App Services, QUANTUM SOFTWARE SOLUTION is in charge of gathering, storing, and handling user personal data.

UPDATES/CHANGES

To reflect required adjustments in technology, current legislation, or any other variation, we may occasionally amend our Policy. In any instance, we retain the right to modify this Policy’s or the Provisions of Use’s terms at any time. Any modifications we make are subject to notification, which we may provide by publishing the revised policy on the Site. After receiving such notification, using the Promise App Services will be taken as acceptance of the modifications. Additionally, we could do our best to send you an email with the information.
